A Patently Clear Case?
Following the latest judgement handed down in the Royal Courts of Justice in London's Strand, it looks like Eurocell is going to have to cough up millions in damages to Ultraframe. The issue was between Ultraframe's Ultralite 500 polycarbonate system for lean-to conservatories and the Pinnacle 500 system from Eurocell. The case dealt with the patented method of fixing the panels, some unregistered design rights and infringement of the design of the panels themselves and the finished product. Our learned friends spent many weeks arguing over the exact meaning of words such as 'interengage' (which turned out not to be in the dictionary, which was considered a plus) and 'arcuate', which means arc shaped unsurprisingly, but threw me for a second or two.

Much seemed to have rested on how and where the fitter put his 'stiffening member', but although this is the season of saucy seaside postcards, I am going to leave that potential thread hanging. Joking aside, it is good news for patient Ultraframe shareholders - many of whom are workers at the company following founder John Lancaster's generous staff option scheme initiated when he took the company public - with shares rising to a six week high of 54p and at least one analyst upgrading the stock from 'reduce' to 'add'. With ongoing litigation in the USA (Four Seasons) and the UK (Burnden Group) this may mark the beginning of a return of City confidence in the old warhorse of the conservatory roof market.

Another major story this week is the sale of Polyex, the company formed by Eurocell founders
Mike Bosworth and Roger Hartshorn, to the Quinn Group, owned by Irish entrepreneur Sean Quinn, which owns the Barlo Group and a very wide portfolio from glass companies to hotels. It is understood that Mike has hung his boots up, while Roger is back in the industry at HL Plastics, the company he originally founded and which Eurocell grew out of. We wish them both good fortune.
